မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေကို ပြင်ဆင်သည့်ဥပဒေ

ပြည်ထောင်စုလွှတ်တော်သည် ဤဥပဒေကို ပြဋ္ဌာန်းလိုက်သည်။
၁။ ဤဥပဒေကို မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေကိုပြင်ဆင်သည့်ဥပဒေဟု ခေါ်တွင်စေရမည်။
၂။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၃ တွင်-
(က) ပုဒ်မခွဲ (၁) ကို ပယ်ဖျက်ရမည်။
( ခ ) ပုဒ်မခွဲ (၅) ၌ပါရှိသော “the age of thirteen years” ဆိုသည့် စကားရပ်ကို “the age of fifteen years” ဆိုသည့် စကားရပ်ဖြင့် အစားထိုးရမည်။
( ဂ ) ပုဒ်မခွဲ (၈) ၌ ပါရှိသော “the dominions of His Britannic Majesty” ဆိုသည့် စကားရပ်ကို “the Republic of the Union of Myanmar” ဆိုသည့်စကားရပ်ဖြင့် အစားထိုးရမည်။
၃။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၃၊ ပုဒ်မ ၄၊ ပုဒ်မ ၇၊ ပုဒ်မ ၁၀၊ ပုဒ်မ ၁၈၊ ပုဒ်မ ၂၃၊ ပုဒ်မ ၂၇၊ ပုဒ်မ ၃၂၊ ပုဒ်မ ၃၄၊ ပုဒ်မ ၄၀၊ ပုဒ်မ ၄၃ နှင့် ပုဒ်မ ၄၄ တို့တွင်ပါရှိသော “the High Court”ဆိုသည့် စကားရပ်ကို “the High Court of the Region or the High Court of the State” ဆိုသည့် စကားရပ်ဖြင့်လည်းကောင်း၊ “the District Court” ဆိုသည့်စကားရပ်ကို “the Court of the Self-Administered Division or the Court of the Self-Administered Zone or the District Court” ဆိုသည့် စကားရပ်ဖြင့်လည်းကောင်း အသီးသီး အစားထိုးရမည်။
၄။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၇ တွင်ပါရှိသော “the Supreme Court of Judicature in England” ဆိုသည့်စကားရပ်ကို “the Supreme Court of the Union” ဆိုသည့်စကားရပ်ဖြင့် အစားထိုးရမည်။
၅။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၈၊ ပုဒ်မ ၁၇၊ ပုဒ်မ ၁၇-က၊ ပုဒ်မ ၁၉၊ ပုဒ်မ ၂၀၊ ပုဒ်မ ၃၇၊ ပုဒ်မ ၅၀၊ ပုဒ်မ ၅၅ ၏ခြွင်းချက်၊ ပုဒ်မ ၅၆ နှင့် ပုဒ်မ ၅၇ တို့တွင်ပါရှိသော “the High Court” ဆိုသည့်စကားရပ်ကို “the High Court of the Region or the High Court of the State”ဆိုသည့်စကားရပ်ဖြင့် အစားထိုးရမည်။
၆။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေပုဒ်မ ၉ ကို အောက်ပါအတိုင်း အစားထိုးရမည်-
“9. When any question of law or usage having the force of law arises at any point in the proceedings previous to the hearing of any suit under this Act by a Court of the Self-Administered Division or a Court of the Self-Administered Zone or a District Court or at any subsequent stage of such suit, or in the execution of the decree therein or order thereon, the Court may, either of its own motion or on the application of any of the parties, draw up a statement of the case and refer it, with the Courts own opinion thereon, to the decision of the High Court of the Region or the High Court of the State.
If the question has arisen previous to or in the hearing, the Court of the Self-Administered Division or the Court of the Self-Administered Zone or the District Court may either stay such proceedings, or proceed in the case pending such reference and pass a decree contingent upon the opinion of the High Court of the Region or the High Court of the State upon it. If a decree or order has been made, its execution shall be stayed until the receipt of the order of the High Court of the Region or the High court of the State upon such reference.”
၇။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၁၃ နှင့် ပုဒ်မ၁၆ တို့တွင်ပါရှိသော “a District Court” ဆိုသည့်စကားရပ်ကို “a Court of the Self-Administered Division or a Court of the Self-Administered Zone or a District Court” ဆိုသည့် စကားရပ်ဖြင့်လည်းကောင်း၊ “the High Court” ဆိုသည့်စကားရပ်ကို “the High Court of the Region or the High Court of the State” ဆိုသည့်စကားရပ်ဖြင့်လည်းကောင်း အသီးသီးအစားထိုးရမည်။
၈။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၁၇-ကတွင်ပါရှိသော “as is exercisable in England by the King’s Proctor,”ဆိုသည့်စကားရပ်နှင့် “to exercise duties of King’s Proctor”ဆိုသည့်စကားရပ်တို့ကိုပယ်ဖျက်ရမည်။
၉။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၅၆ တွင်ပါရှိသော “or of any Division Court” ဆိုသည့် စကားရပ်ကို ပယ်ဖျက်ရမည်။
၁၀။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၅၆ နှင့် ပုဒ်မ၅၇ ၏ခြွင်းချက်တို့တွင် ပါရှိသော “the Supreme Court” ဆိုသည့်စကားရပ်ကို “the Supreme Court of the Union” ဆိုသည့်စကားရပ်ဖြင့်အစားထိုးရမည်။
၁၁။ မြန်မာနိုင်ငံလင်မယားကွာရှင်းရေးအက်ဥပဒေ ပုဒ်မ ၆၂ တွင်ပါရှိသော “the High Court” ဆိုသည့် စကားရပ်ကို “the Supreme Court of the Union” ဆိုသည့် စကားရပ်ဖြင့် အစားထိုးရမည်။
ပြည်ထောင်စုသမ္မတမြန်မာနိုင်ငံတော် ဖွဲ့စည်းပုံအခြေခံဥပဒေအရကျွန်ုပ်လက်မှတ်ရေးထိုးသည်။
